Boy Sentenced to 40 Years in Prison After Killing Asleep Father With 357 Magnum

A 13-year-old boy was sentenced to 40 years in prison after killing his asleep father with a 347 Magnum, he got from his parents' room, the Los Angeles Times reported Thursday.

According to the report, a judge ruled that the young boy be sentenced to 40 years in prison, including a maximum of 10 years service under the juvenile justice center.

Despite the efforts of the Riverside County boy's lawyers to subject him to a rehab facility instead, the judge's decision was final, Examiner reported.However, it was clarified that the 13-year-old can only be under custody until he is 23; thus, a parole hearing was mandated, and it will be held 7 years after, by the time he is 20.

The boy was identified as Joseph Hall, and according to reports he was guilty of second-degree murder and the use of a gun in committing the crime. 

According to Examiner, Hall was sentenced to 40 years after he killed his father in 2011. His father was a "regional leader of the National Socialist Movement and used to organize neo-Nazi rallies."Court documents noted that Hall used a 357 magnum, which he got from his parent's bedroom.

Part of the ruling was to ensure that Hall will be banned from owning a firearm until he turns 30.

Based on the statements of young Joseph's lawyers, his action was a product of "years of abuse." But it was proven that the boy had long history of inflicting pain to other people prior to murdering his own father.

"Joseph was repeatedly expelled from his school after violent outbursts, including strangling a teacher with a phone cord," reported Buzzfeed. "He also attacked female teachers and fought with other students during his two years at Riverside Juvenile Hall."
