The Hulk vs Gawker: Sex Video Trial Postponed

NZHerald reported that the ongoing legal battle between WWE's legend Hulk Hogan and digital media Gawker had been postponed.

The sex video trial was set to begin on Monday, but the 2nd District Court of Appeal passed a procedural evaluation regarding trial regulations. It stated some defense actions were filed too near the set scheduled date for the trial to begin.

No date has been announced for the new trial.

Hogan, whose real identity is Terry Bollea, sued Gawker in a Pinellas County court for damages worth $100 million for releasing a part of the sex tape he made with Heather Clem, the ex-wife of his erstwhile buddy, radio show anchor Bubba the Love Sponge Clem.

Gawker defended its action saying it was justified in publishing parts of the video because the wrestler detailed his sex life prior to the release of the video, thus making the story noteworthy.

The New York Post revealed Gawker's top honcho Nick Denton was at Manhattan's Gramercy Cafe early Thursday morning, when he caught wind that his 13-year-old website may have dodged the bullet for now. The lawsuit Hogan filed may possibly spell a death sentence for the company.

"I will be able to take a summer vacation after all," he said, noticeably relieved at the turn of events.

Gawker Media Group profits increased from 9.5 percent last year to $6,529,821 from that of 2013. While some private firms keep their financial information guarded, Denton, looking forward to being forced to reveal the numbers in public at the trial, released detailed stats on Thursday.

Meanwhile, Gawker's lawyers, implied in a separate Florida federal court on Thursday, that the government may have tampered the DVDs, as told by Buzzfeed.

Seth Berlin, lawyer for the company, said he compared the three tapes' transcripts created while in FBI possession to that of his recent view and declared to the judge that a portion did not add up to the transcripts.

He said, "There is something that is particularly of sensitive and of interest to us in the case and that is the portion that has been overdubbed. So we have two CDs with two different video and for a portion of it the audio is the same. I want to understand how it is that between that moment when the FBI took possession of those DVDs and when I saw those tapes...on Tuesday, that audiogot changed." He then added, "It smells like bad fish."
